2001年4月28日我国婚姻法进行修改，建立了离婚损害赔偿制度。但是由于我国的离婚损害赔偿制度起步相对较晚，而且法律规定又过于简单，所以其在立法上还存在很多的缺陷，在司法实践中还存在不少的问题。经过近些年的研究，我国学者提出了很多关于完善离婚损害赔偿制度的建议。这些建议主要是从立法的角度提出的，从司法实践的角度提出的就很少了。而且这其中的有些建议本身还存在一些问题，有很多都不符合实际情况。譬如有些学者提出精神暴力也应被列为离婚损害赔偿的情形，在我国夫妻间的吵闹被大多数人认为是家庭琐事，即使很严重的吵闹只要不涉及到肢体冲突都会被认为是很正常的事，所以将精神暴力列为离婚损害赔偿的情形在我国是行不通的。还有些学者提出应该对离婚损害赔偿的数额进行具体规定，但是实际情况是千变万化的，这种方法无法将所有情况都加以规定。笔者认为要想更好的完善我国离婚损害赔偿制度就应当以从实际出发为前提，同等重视立法缺陷和司法实践问题，从立法和司法两个方面对我国的离婚损害赔偿制度进行完善。
